Terms of Service

Welcome to 404Nerds (the "Service"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and related services (collectively, the "Service") operated by 404Nerds, AjaxSelectButtonGames ("we", "us", or "our"). By using the Service you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. If you are under the age required by your country to consent to use of the Service, you may only use the Service with the involvement of a parent or guardian where required by applicable law.

Certain features or content, including content designated as mature or NSFW, may be restricted to users who affirm that they are at least 18 years old and explicitly choose to enable access to such content.

2. Accounts

To use certain features you must create an account. You are responsible for safeguarding your account credentials and for activity occurring through your account. Notify us promptly if you believe your account has been accessed or used without authorization.

You agree to provide accurate information when reasonably required for use of the Service and not to circumvent account restrictions, suspensions, content controls, or other security or moderation features.

3. User Content

The Service may allow you to post, upload, stream, store, publish, or share content including text, images, games, software, audio, video, livestreams, and other materials ("User Content").

You retain ownership of your User Content. By submitting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to host, store, reproduce, process, modify, display, distribute, and otherwise use your User Content as reasonably necessary to operate, provide, improve, secure, and promote the Service.

You are responsible for your User Content and for ensuring that you have the rights, licenses, permissions, and authority necessary to upload, publish, stream, or otherwise make that content available through the Service.

We may review, classify, reclassify, restrict, age-restrict, obscure, limit the distribution of, remove, or disable access to User Content when we reasonably believe that doing so is necessary to enforce these Terms or our policies, comply with applicable law, protect users or the Service, or address safety, security, or operational concerns.

The availability of similar content elsewhere on the Service does not guarantee that particular User Content will be permitted or treated in the same manner.

4. Prohibited Conduct

You agree not to use the Service to:

• Violate applicable law, infringe another person's rights, or upload, publish, stream, or distribute content that you do not have the legal right to distribute;
• Exploit, endanger, sexualize, or facilitate the abuse or exploitation of minors;
• Upload, publish, distribute, request, or facilitate sexual content involving minors or any material depicting or promoting the sexual exploitation of minors;
• Publish or distribute non-consensual intimate or sexual material;
• Harass, abuse, stalk, threaten, defame, or encourage violence against another person;
• Upload viruses, malware, intentionally harmful code, or other material designed to compromise the Service or another person's systems or data;
• Impersonate another person or organization or materially misrepresent your affiliation with another person or organization;
• Use the Service for fraud, spam, deceptive activity, or other abusive behavior;
• Circumvent or attempt to circumvent access controls, age restrictions, content filters, moderation systems, suspensions, security measures, or other restrictions imposed by the Service;
• Intentionally mislabel User Content in order to evade content restrictions, filtering, moderation, or age restrictions;
• Interfere with, disrupt, overload, damage, or gain unauthorized access to the Service or servers, systems, or networks connected to the Service.

5. Mature and NSFW Content

The Service may permit certain mature, sexually suggestive, violent, or otherwise sensitive content ("NSFW Content") at our discretion.

Users who upload, publish, or stream NSFW Content must appropriately identify or label that content using the tools provided by the Service. Users must not intentionally misrepresent NSFW Content as suitable for general audiences.

We may change a content classification, apply warnings or restrictions, obscure previews or thumbnails, limit visibility or distribution, age-restrict content, or remove content when we determine that doing so is appropriate for the Service.

Access to NSFW Content may be limited to users who affirm that they are at least 18 years old and explicitly enable access to such content. NSFW Content may be excluded from general discovery, previews, recommendations, feeds, or other areas of the Service.

Labeling content as mature or NSFW does not make otherwise prohibited or illegal content permissible.

We reserve the right to determine what mature or NSFW content is permitted on the Service and what restrictions, classifications, or visibility limitations apply to that content.

6. Payments and Verified Purchases

We may offer paid services or features (for example, account verification badges) that are processed by our payment provider, Paddle. By making a purchase you agree to pay all applicable fees and taxes associated with that purchase and to the payment provider's terms in addition to these Terms.

Checkout and passthrough: During checkout we may use a server-side passthrough mechanism to associate a payment with your account. Do not attempt to manipulate payment payloads or passthrough values.

Refunds and disputes: Our refund policy is described on the relevant purchase page and/or during checkout. If a refund is required, we will follow the payment provider's refund process.

For disputes, please contact support at support@404nerds.com. We will cooperate with Paddle in resolving chargebacks, refunds, or other payment-related disputes.

7. Intellectual Property

The Service and its original content, features, software, branding, and functionality are owned by 404Nerds or its licensors and are protected by applicable intellectual property laws.

Except as permitted by these Terms or applicable law, you may not copy, modify, distribute, or create derivative works from the Service itself without our permission.

Nothing in this section transfers ownership of User Content to 404Nerds.

8. DMCA and Copyright

If you believe User Content infringes your copyright, please provide a notice containing the information required by the Digital Millennium Copyright Act (DMCA) to our designated agent.

9. Moderation, Suspension, and Termination

We may investigate suspected violations of these Terms and may remove or restrict User Content, limit access to features or distribution, suspend accounts, or terminate access to the Service when reasonably necessary to enforce these Terms or our policies, protect users or the Service, comply with legal obligations, or address abuse, security, or operational risks.

Where appropriate, we may provide warnings or an opportunity to correct a violation, but we are not required to do so in every circumstance.

We may also take reasonable action regarding content or activity not expressly described in these Terms when we determine that it creates a material legal, safety, security, or operational risk to the Service or its users.

Repeated or serious violations may result in permanent account termination. Attempts to evade a suspension or termination may result in additional accounts being restricted or terminated.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied.

To the fullest extent permitted by applicable law, we disclaim warranties including merchantability, fitness for a particular purpose, non-infringement, availability, reliability, and security.

We do not guarantee that User Content will always remain available, that the Service will operate without interruption, or that stored content or data will never be lost or damaged.

11. Limitation of Liability

To the maximum extent permitted by applicable law, 404Nerds and its affiliates, officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or use, arising out of or in connection with the Service.

12. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless 404Nerds and its officers, directors, employees, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from your User Content, your use of the Service, your violation of these Terms, or your violation of another person's rights.

13. Changes to Terms

We may revise these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting a notice on the Service or contacting users where appropriate, before the changes become effective.

Your continued use of the Service after the effective date of revised Terms constitutes acceptance of those Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where 404Nerds is organized, without regard to conflict-of-law principles.

Any disputes arising under or in connection with these Terms will be subject to the jurisdiction of the courts located in that jurisdiction, except where applicable law provides otherwise.
